Investigators with the U.S. Department of Labor’s Wage and Hour Division found that the West Virginia Office of Miners’ Health, Safety and Training failed to pay inspectors who worked overtime without pre-approval, U.S. Department of Labor reports.

The agency paid inspectors for a set amount of scheduled hours only. They were instructed not to submit more than 40 hours per week on their timesheet, violating the Fair Labor Standards Act.

The back wages recovered by the agency reportedly totalled $57,396.

“All employers, public and private sector, are legally required to pay their employees the proper wages for all hours worked,” Wage and Hour Division District Director John DuMont in Pittsburgh, Pennsylvania said. “Employers unsure of their obligations should contact the Wage and Hour Division to avoid compliance concerns and potential violations.”

Further information about the FLSA and other laws enforced by the Wage and Hour Division is available here or through the division’s toll-free helpline at 866-4US-WAGE (487-9243).
