[Mexico] Federal labour law amendment approved in Mexico

With an objective to modernise the labour justice system, Mexico’s House of Deputies has approved the amendment of the Federal Labour Law, JD Supra reports.

The amendment regulates the constitutional amendments of Articles 103 and 123, which have been in effect since February 24 2017. Any modernisation of the justice system must be in line with both Agreement 98 of the International Labor Organization (ILO) and Annex 23 of the United States-Mexico-Canada Agreement (USMCA).

The House of Senators is expected to approve the amendment. If approved, it will be published on May 1.

Key changes to Federal Labour Law include:

  • Regularisation for personnel services outsourcing
  • Union democracy and freedom of collective bargaining
  • The creation of a Conciliation and Union Registry Center
  • Guidelines for the operation of new labour courts
  • Reforms to the Labour Procedure
  • Consideration of human rights and gender perspective

Other changes of note affect the nomination of beneficiaries for death benefits in individual working contracts, termination agreements and employee rights waivers, notices of termination and employer’s obligations towards household employees.
